YGORXKHARO provides technology, software, consulting, and related business services as agreed with clients from time to time.

The scope, deliverables, timelines, and pricing applicable to any engagement shall be governed by a separate written agreement, quotation, proposal, or statement of work.

2. Payment

Payment terms will be specified in the applicable agreement, quotation, or invoice.

Unless otherwise agreed in writing:

• Invoices are payable within thirty (30) days of issue.
• Late payments may incur interest at the maximum rate permitted by law.
• We reserve the right to suspend or terminate services where payments remain outstanding.

3. Intellectual Property

Unless otherwise agreed in writing:

• All intellectual property created by YGORXKHARO remains the property of YGORXKHARO until all amounts due have been paid in full.
• Upon full payment, ownership and licensing rights shall transfer in accordance with the applicable service agreement.

Pre-existing intellectual property, methodologies, software frameworks, and proprietary tools developed by YGORXKHARO remain the property of YGORXKHARO.

4. Confidentiality

Both parties agree to keep confidential any proprietary, commercial, technical, or sensitive information disclosed during the course of an engagement and not to disclose such information to third parties except where required by law.

5. Limitation of Liability

To the fullest extent permitted by law:

• YGORXKHARO shall not be liable for any indirect, consequential, incidental, special, or punitive damages.
• Our total liability arising from any claim relating to services provided shall not exceed the total fees paid by the client during the three (3) months immediately preceding the event giving rise to the claim.

6. Website Use

Users agree not to:

• Use this website for unlawful purposes;
• Attempt to gain unauthorized access to systems or data;
• Distribute malicious software or harmful content;
• Interfere with the operation or security of the website.

We reserve the right to restrict or terminate access where these conditions are breached.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.

Any dispute arising from these Terms shall be subject to the jurisdiction of the South African courts.

8. Amendments

YGORXKHARO may amend these Terms and Conditions from time to time.

Continued use of the website or our services constitutes acceptance of the updated Terms.

Refund Policy

Project-Based Services

Deposits paid for project-based work become non-refundable once work has commenced.

If a project is cancelled before any work has begun, any deposit paid will be refunded within fourteen (14) business days.

Milestone-Based Services

Payments relating to completed milestones are non-refundable.

Payments made for future milestones that have not yet commenced may be refunded in full at YGORXKHARO’s discretion or as provided in the applicable agreement.

Retainer and Maintenance Services

Monthly retainer or maintenance fees are non-refundable for the current billing period.

Clients may terminate ongoing retainer arrangements by providing thirty (30) days written notice.

No further charges will accrue after the notice period expires.

Service Disputes

If you are dissatisfied with any aspect of our services, please contact us directly so that we may investigate and resolve the matter in good faith and as promptly as reasonably possible.

Privacy Policy

YGORXKHARO (Pty) Ltd respects your privacy and is committed to protecting your personal information in accordance with the Protection of Personal Information Act, 2013 (“POPIA”).
